Pending Applications and Status

 

NEW AND PENDING APPLICATIONS

 

1. DP 08-06 by Mary Rose Bushroe on behalf of Dance Reach with Mary Rose requesting to allow a change of use at 10516 Sawmill Road, to allow a birthday party business to exist in the building, located in an area designated for suburban office use within Wedgewood Commerce Center.  On April 23, 2008 the Zoning Commission voted to recommend approval with conditions.  Approved minutes have been submitted to the Trustees, who can now set a final hearing date & time.

 

2. ADMINISTRATIVE REVIEW #07-07 by Jim Phieffer for Jewett Road Associates requesting to amend the Derby Glen Farms (PR) Development Plan to allow SmartSide as a ‘natural’ material for the single-family homes.  The applicant tabled at the July 18, 2007 Zoning Commission hearing in order to meet with area homeowner associations.  The 2nd Zoning Commission hearing will be scheduled at a later date.

 

3. ADMINISTRATIVE REVIEW #07-04 by Peter Misuraca, Eric Pearson, Robert Medrano, Mark Pickard, Brooks Williams, David MacDonald, Robert Stafford, Curtis Graham, and Michael Jacobson requesting to amend the Wedgewood Park development plan to reduce the natural green space/no-build zone at the rear of lots #3746-3755 (excluding lot 3753) from 75’ to 25’.  The Trustees designated this as a major application on April 23, 2007.  At their June 6, 2007 meeting, the Zoning Commission voted to continue this hearing to 7:30 p.m., Wed., Oct. 24, 2007 to allow all the applicants time to consider this application and submit any revisions.  Dawn Pearson (one of the property owner/applicants) appeared at the Oct. 24th Zoning Commission hearing and requested additional time; the Zoning Commission voted to table this application.  At their Feb. 20, 2008 meeting, the Zoning Commission voted to remove this application and hear it on Wed., May 21, 2008 at 7:30 p.m.  The applicants have been so notified and advised to submit revisions; alternatively, the Zoning Commission will vote on the original submittal.

 

4. ADMINISTRATIVE REVIEW #05-06 by Greystone Ohio LLC requesting to allow tenants that occupy more than one tenant space to use more than one sign band to display their business name at 4060 Presidential Parkway.  The Trustees designated this as a major application and referred it to the Zoning Commission. The applicant tabled at the April 13, 2005 Zoning Commission hearing; the 2nd hearing will be scheduled after the applicant submits revisions.

 

5. ADMINISTRATIVE REVIEW #03-03 by Loch Lomond Farm Company requesting development plan amendments to allow construction of 36 condominiums (reduced from the originally requested 45 condos) and the public road connection between Loch Lomond Drive and Manning Parkway.  The applicant tabled at the April 16, 2003 and January 18, 2006 Zoning Commission meetings.  On March 22, 2006, the Zoning Commission voted for conditional approval.  The applicant tabled at the Trustees’ final hearing on Wed., May 3, 2006, to work out the existing roadway easement issues with the Delaware County Engineer; after this is accomplished, and revisions, if needed, are submitted, the final hearing will be scheduled again.  The property is now owned by CKI Loch Lomond Ltd. so a revised application will be required with any future submittal.

 

6. DP 08-07 by Tonya Sallee on behalf of Steak n Shake Company, requesting preliminary and final development plan approval for a KFC/Taco Bell restaurant proposed to be developed at 4072 Powell Road (lot #3639 of The Market at Big Bear).  The first Zoning Commission hearing is scheduled for 7:30 p.m., Wed., June 18, 2008.

 

7. DP 08-05 by Michael Fitzpatrick and Jeff Meacham on behalf of Three Rocks & A Boulder LLC requesting amendments to The Shoppes at Liberty Crossing preliminary & final Development Plan.  The applicant tabled at the March 26, 2008 Zoning Commission hearing; the 2nd hearing will be scheduled after revisions are submitted.

 

8. DP 08-04 by Todd Wyett on behalf of The Market at Liberty Crossing requesting preliminary & final development plan approval in The Market at Big Bear, to allow 4 new commercial buildings not attached to the shopping center, with associated parking, lighting, landscaping, etc. DCRPC recommended conditional approval at their Feb. 28, 2008 meeting. The applicant tabled at the March 12, 2008 Zoning Commission hearing; revisions have been submitted and the 2nd hearing is scheduled 7:30 p.m., Wed., May 14, 2008.

 

9. DP 08-03 by Paul Goggin on behalf of Columbus State Community College requesting final development plan approval for a community college on their property at 5100 Cornerstone Drive.  This has been submitted to the Delaware County Regional Planning Commission for review and recommendation, and is expected to be on their Feb. 28th agenda.  DCRPC recommended conditional approval at their Feb. 28, 2008 meeting. The applicant tabled at the April 9, 2008 Zoning Commission hearing.  Revisions have been submitted and the 2nd hearing is scheduled for 7:30 p.m., Wed., May 21, 2008.

 

10. DP 08-01 by Bruce Macauley on behalf of The Kroger Company, requesting to modify the development plan for lot #3675 of Wedgewood Commerce Center Section 3 Part a Resubdivision Plat, to allow replacement of the walk-up pharmacy recently approved for the Kroger store at 3975 W. Powell Road, with a drive-thru pharmacy at the same location.  The applicant tabled at the Feb. 20, 2008 Zoning Commission meeting.  Revisions have been submitted and the 2nd hearing is scheduled for 7:30 p.m., Wed., June 11, 2008.

 

11. DP 07-05 by P & P Real Estate requesting to amend the Gold’s Gym development plan to subdivide the property into 2 lots, and requesting final development plan approval for the 2nd phase of their development to consist of a retail center, at the southeast corner of Seldom Seen Rd./Sawmill Parkway (in the Seldom Seen Acres subdivision).  The applicant tabled at the Aug. 22, 2007 Zoning Commission hearing.  The 2nd hearing will be scheduled after revisions are submitted.

 

12. LTZ 07-01 by Marcia Rush, Trustee requesting to rezone 109+ acres at 7201 Liberty Road from FR-1 to PR for 53 single-family lots and 152 condominiums.  At their June 28, 2007 meeting, the RPC recommended approval.  The applicant tabled at the July 19, 2007 Zoning Commission hearing.  The 2nd hearing will be scheduled after revisions are submitted.

 

13. LTZ 06-03 by Paul and Victoria Sherer requesting to rezone 5.917 acres from FR-1 to PR for 11 single-family lots at 10477 Liberty Road (1.86 DU/AC).  The RPC recommended approval with conditions on May 25, 2006.  The applicants tabled at the June 14, 2006 Zoning Commission hearing.  No revisions have been submitted yet, for a 2nd hearing.

 

14. LTZ 05-03 by Ken Manning on behalf of Loch Lomond Farm Company, requesting to rezone 2.82 acres from PC to PERRC and 5.226 acres from PC to PERRC for an assisted living and nursing home facility proposed at 10410 Olentangy River Road.  On May 26, 2005 the RPC recommended denial of the rezoning.  The applicant tabled at the June 8, 2005 and again at the Jan. 25, 2006 Zoning Commission hearings.  Revisions were submitted requesting a significantly reduced project size, no longer requesting approval for assisted living.  The applicant tabled at the March 28 and Dec. 13, 2007 and April 30, 2008 Zoning Commission hearings.  The 5th hearing will be scheduled after revisions are submitted.

 

15. LTZ 04-07 by multiple applicants requesting to rezone 310.37 acres from Farm Residence District to Planned Residence District for 336 single-family lots and 129 condominiums, north of Home Rd., south of Hyatts Rd., from Hyatts Road east to Sawmill Parkway to be known as Liberty Point  The applicant tabled at the Dec. 14, 2004 Zoning Commission hearing.  An amended application (adding 50 acres) and revisions were received.  The applicant tabled at the May 25, 2005 and at the September 14, 2005 Zoning Commission hearings. The third hearing will be scheduled after revisions are submitted.  A letter from Dominion Homes dated 9/6/06 states that Dominion wishes to withdraw the rezoning application for the Jackson, Pearl, Turrill, and AEP tracts.  The property owners have not yet notified the zoning office of their intentions so the application remains pending. 

 

16. The Zoning Commission initiated text amendments to the Liberty Township Zoning Resolution, in public meeting on June 18, 2003 (for amendments to the Planned Residence District and creation of a Multi-Family Planned Residence District). The Delaware County Regional Planning Commission recommended approval on June 26, 2003.  The Zoning Commission, Board of Trustees and Board of Zoning Appeals held a public hearing on Tuesday, July 15, 2003.  This was put on hold for the PC regulations to be amended and for the Comprehensive Plan to be updated.  An organizational meeting of the Zoning Commission, Trustees, and Board of Zoning Appeals was held Thursday, April 6, 2006 and the decision was made to review the entire zoning code.  Zoning Commission meetings to work on code revisions were held Jan. 16 and 30, 2008.  Additional meetings will be scheduled after additional drafting is completed.

 

17. BZA 08-09 by R. Bruce Miller, Jr. & Beth A. Miller requesting Conditional Use approval for a home occupation (Miller Craftsmen & Builders Inc.) at their home, 9798 Riverway Run.  The BZA hearing is not yet scheduled.

 

18. BZA 04-28 by Charles J. Ruma, President of Wedgewood, Inc., on behalf of Wedgewood Limited Partnership I:  Appeal of the zoning inspector’s denial of application for a zoning certificate, which was to build a WalMart store in Wedgewood Commerce Center, at 10600 Sawmill Parkway, Powell, Ohio on Lot #2069 of Wedgewood Commerce Center Section 1 subdivision.  BZA hearings were held on 11/16/04, 11/29/04, 12/07/04, and 01/11/05, at the conclusion of which the BZA upheld the zoning inspector’s denial of the zoning permit.  This case was appealed to the Delaware Court of Common Pleas and remanded to the BZA by Judge Whitney.  To date, BZA hearings have been held 09/11/07, 09/28/07, (exception - the 10/09/07 hearing was not reopened;  one BZA member was absent and the appellant elected to not go forward without having all 5 members present), 10/30/07, 11/08/07, 11/29/07, 12/11/07, and 01/29/07 (exception: the BZA voted to resume the hearing on Feb. 26, 2008 and postponed that to April 1, 2008 to provide attorneys opportunity to review additional evidence; the April 1, 2008 BZA hearing was rescheduled to Tues., April 29, 2008. The hearing will resume at 7:30 p.m. on Tuesday, May 6, 2008 at the Liberty Township Hall, 7761 Liberty Rd.
